Regulations - Use of Microphone in Vehicles
Regulation 47 of the PSV (Regulations) (NI) 1985 [SR 1985 No. 123] (as substituted by regulation 2(11) of the PSV (Amendment) (Regulations) (NI) 1990 [SR1990 No. 201]) sets out the condiitions governing, among other things the use of microphones on vehicles. Regulation 47 (1) prohibits a driver from holding a microphone when a vehicle is in motion unless in an emergency or on grounds of safety. Regulation 47(2) prohibits a driver from speaking to any person (including using a microphone) when the vehicle is in motion. However regulation 47(3) disapplies the prohition in certain circumstances including in relation to an excursion or tour provided the driver is not distracted from his driving of the the vehicle.
In conclusion a driver giving a tour can use a microphone while driving provided he is not distracted from his driving of the vehicle.
